Specifically, where Morality defines the ethics of human behavior, Legitimacy seeks a common good while Legality serves to administer the legitimacy of common good.

Legitimate Morality, without legal control, upholds security within possible disorder. Without legitimate nor legal foundation, Morality prevails with no sense of security nor any appearance of order. Legal Morality, lacking any form of legitimacy, invites chaos.

The legitimacy of laws is therefore of paramount importance to the security of a collectivity seeking to thrive according to valid Rule of Law. Sovereignty is acquired where legitimate norms are legally administered by the host system that secures them.

The legal administration of legitimate norms cannot be applied nor construed in a manner altering sovereign interests. Rules of Law must also secure the substantive ambit of Law. Thus, it is important to grasp these moral, legitimate, and legal distinctions, in that particular order, so as to better assimilate the governing logistics supported in this White Paper.* - DC

3. Rights and Freedoms must never induce wrongs. Where the exercise of a Right or Freedom unduly affects the enjoyment of other rights and freedoms is where such exercise, when conflictual, provokes a tort. Rights and Freedoms securing Life, Liberty, and Security, prevail. Rights and Freedoms offensive to human dignity and worth lose all legitimacy. The exercise of Free Speech is measured as a threat when its manifestation explicitly anticipates a violation of Rights and Freedoms. Freedom of Expression can only be limited in a manner ensuring its manifestation upholds the primacy of Life, Liberty, and Security - Self Defense viewed as the legitimate ultimate recourse against manifested evils. 4. While the morals of some may not necessarily reflect the morals of others, their explicit expression belongs in the private realm. Good Governance requires that Sexuality and Religion, whose private expressions cannot be regulated by Law, must not, under reciprocity rule, be expressed by government agents during public office. Customary / traditional Law, susceptible to permutation across adhering generations, may nonetheless remain under the scrutiny of a Divine Order. 6. Notice I mention valid Rule of Law. Rule of Law, as per Primacy of Law, can easily be swapped for Rule of Person. How? Through substitution of Supervisory Control. Remember the system of Checks and Balances. For the layperson, a simple analogy comprising the administration of a bank account is sufficient to underline the concept. What this ultimately means is that a Banker ( our friendly government ) must abide by some form of guarantee ( our written Constitution ) that safeguards the People's rightful earnings ( our Rights and Freedoms ). 7. A reactive governing formula, hostile towards constitutional safeguards, substitutes itself to the People's Will and favors corruption and fraud over integrity and legitimacy. Such an anti-democratic incursion invites arbitrariness and forces victims, whose rights are denied, to utilize the courts in order to attempt to secure constitutional guarantees that public authorities have, a priori, the obligation to promote and protect. A government of corruptors is the reflection of such a formula within societies claiming to be free and democratic that bypasses valid legislative scrutiny and favours corporate governance over Sovereign Democracy. 8. Where Law is a constraining ideal sanctioned by rule is where Rule of Law serves to regulate the prescriptions of Law through supervisory control of their formulation and execution. 9. The impact of terrorism, whether moral, social or political, provokes detrimental effects extending far beyond the damage suffered by its vicinity. It matters not that terrorism be legally definable as a particular offense according to different legal frameworks, it matters that its manifestation be jointly condemned and universally perceived as the alienation and devalorization of human dignity and worth. Terrorism can also be the consequence of acts and omissions whose manifestations are detrimental to individual and collective liberties. 10. Globalization deals a significant blow to everything democratic when its economic impact does not ensure the durability of sovereign economies. Heavy dependency to global markets exposes weaknesses of client Nations. Hence, future transnational conflicts may need not be provoked nor resolved strictly through conventional military means - merely strangling dependent foreign economies and finances would likely be sufficient to arrive at a more durable and less costly result. Such impacting sanctions must be deployed substantially, swiftly, and concurrently in order to have an immediate effect systemically. Substituting a sovereign nation's work force and regulatory control for some cheaper foreign alternative also constitutes a threat to national security. 11. In retrospect, the lack of obligatory subscription to enforceable universal norms and standards inevitably reflects on the quality of our environment. Globalization, without appropriate regulatory control, becomes an economic and environmental disaster on a global scale where the offer for cheaper goods and services far surpasses the demand for durability and quality. Ultimately, the health and well-being of humans directly relate to the invasive byproduct of mass popular consumer trends. Where energy converts to garbage is where such energy fuels the virus - we tend to act like viruses when dealing against the laws of nature.  ...

12. Illusions can be deceiving. Technology and Law may go to great lengths in redefining what should be humane and what is a necessary evil. But what would exceed reason would be to realize that where some technological feat attempts to liberate our body (and brains) from overload, the more its impact could put our brains (and body) into deep sleep. 13. Human population growth, livestock growth, and rampant globalization: Three factors endangering Life on earth where sustained via uncontrollable means. Economies that do not currently rely on minimal requirements of conservative sustainability seek to thrive on indiscriminate abusive consumption on a global scale. Planned obsolescence contributes in compounding the effects of human-induced climate change. The byproducts of excessive production and consumption clearly overwhelms the natural capacity to sustain a manageable natural equilibrium - global release of harmful levels of carbon dioxide, methane, and ethylene evidently provoked by egregious human activity and greed.  ...

14. Human Rights are intrinsic to the safeguard and valorization of human dignity and worth, and a pillar in maintaining Democratic Order. Ensuring Liberty, Unity, and Equity, hence the necessity of defending social order under Rule of Law, requires the legitimate recognition of universal Rights whose weighted moral values are worth the freedom of their manifestation. 15. Nothing is new, Everything is discovered. Science and Religion simply cannot mix. You cannot define in scientific terms what Religion is all about. You cannot define in religious terms what Science is all about. There are, however, similar outcomes within the administration of Religion and Science: Both, when abused, provoke harm. That is why it is the effects -- and only the effects -- that determine the efficiency of any public policy deriving from facts and beliefs. Customs may come and go, however, irrefutable facts remain forever. Where it becomes customary law to repudiate verifiable facts is where beliefs invite chaos. If Science and Religion rely on rules professing a code of conduct for the individual and the collectivity, those rules must allow scrutiny by those subjected to their prerogatives. 16. If we are not born violent, we can learn to be violent. All forms of mediums using violence for commercial end or ideological propaganda are those whose authors and distributors promote violence. Promoting violence, regardless of its expressed form, entertains a culture of primitive thought process going against the safeguard and valorization of human dignity and worth. Cognitive response to violence is influenced by the nature of the violent agent: Self-defense is reactive when directly confronted with violence, and proactive when dealing with the prevention of violence. 17. In a true democracy, the Peoples are the employer of their representatives and government administration, not the contrary. The executive and judicial branches of government must be comprised of administrators governing under the absolute powers of a People's parliament. Do not be fooled: The exercise of Democracy absolutely does not end at the ballot box, far from it. The DDRF also serves to eliminate daily deficiencies within the administration of governance, which protects the sovereign Will against arbitrary rule. Separation of Powers, when left unchecked, is offensive to Democracy. The DDRF comprises a Democratic Justice section which regulates the proactive role citizens must play when securing democratic order.  ...

18. Warfare has everything to do with protecting vital interests. When those interests are corporate in nature, warfare is founded on monopoly and greed, with subsequent civil chaos becoming an invitation for arms commerce. Warfare is subsidized by warmongers: Those who manufacture arms; those who use arms to promote viral wars; and those who feed on the formers to secure their viral needs. This symbiosis simulates that of a viral disease, where viral vectors feed on duplication permitting the perpetual extension of conditions sustaining their vital interests. Eliminating viral agents is twofold: Proactive self-defense measures that hit at the top of the viral chain; and reactive self-defense measures that destroy any link to the viral need sought. 19. Justice is valid when imprescriptible, never inaccessible. The legal process must absolutely ensure the right to access to justice and appropriate remedies, not the contrary. Between Justice and the litigant, there can transpire a semblance of logical reasoning or emotional belief, but pragmatism serves Justice, not arbitrariness. Legal players whose logic equates that of a virus are plentiful. In fact, so plentiful, that the cogs of futile Justice reverberate daily within their lucrative system of deceit. The legal industry comprises a vast network of professionals whose means of survival correlate with what their justice system and justice seekers have to offer. 20. Sovereign conservatism, as opposed to corporate liberalism, seeks to ensure the perennity of established Democratic Order. Democratic Order can only be guaranteed via legitimate rules and customs securing sovereign democratic institutions and their enabling Legal Order. Hence, the life span of any Democratic Order directly relates to the legitimate foundation on which it depends. Immigrants cannot participate in fashioning the host territory's political orientations, however, their children may, and only if born in the host region and meeting enabling legislative framework criteria. 21. Democratic governance and corporate governance are two opposing ideals. Good governance, administered in accordance with a democratic legislative framework, seeks to guarantee reliable, cost-effective, universal services tailored for the individual and collective needs of society. Good governance, administered via a corporate financial framework, offers target-oriented services tailored for private corporate needs. Besides the dangers of dubious quality and costly futility, privatization of public services undermines political accountability at the benefit of the very few who dare profit, among other things, from cost overruns. Governments relying on quotas entitling budget review entertain ministerial fraud and abuse of power. Government austerity programs, when left unchecked, invite corporate governance on a systemic scale. Austerity measures crafted by government departments, whose undemocratic effects encourage the privatization of public goods and services, are policies authorized by charlatans. Where constitutional or statutory law does not ensure legislative measures protecting democratic institutions against incursions of private nature is where such law devolves Democratic Order.  ...

22. Social ethics, according to the administration of social morality, thrives on common decency. Common decency is most useful when safeguarding and valorizing human dignity and worth. Individuals challenging collective ethics act as free radicals which can provoke ripples of discontent. Privately manifesting one's moral preferences cannot be of any concern for the collectivity - the private conduct of human behavior driven by personal ethics which simply cannot be alienated. Publicly engaging one's diverging morals may be challenged by those founded upon common decency, however, it is not as much the impugned moral conduct itself that would defy adopted social conduct but rather the unethical grounds upon which it relies. 23. A government of fools takes shape through an electorate of fools. Intellectual fools are void of anything intelligent. Intelligence reflects a qualitative appeal which cannot be calculated in numbers. While intelligence needs not link its rationality with memory, intelligent reasoning, based on past experience, helps to predictably arrive at goals avoiding obstacles and past mistakes. The intellect of any individual derives from knowledge attained through assimilation of data. Reminder: Our brains are not databases, Cognitive feedback is what makes us human. The intellectual needs not make use of cognitive feedback and past experience, however, memorization of data, which can be quantified, has nothing to do with intelligence. Emotions have a hard time reconciling with intelligence. Erratic emotions are the by-product of cognitive dissonance which inhibits the capacity for rational reasoning. Good governance therefore requires that intelligence overrules any decision-making process governed by emotions and arbitrary rule.  ...

24. No individual can be immune from valid Rule of Law, and where legal immunity subsists is where the enabling Law or decision must be rendered void and without effect. Valid Rule of Law dictates, inter alia, the relinquishment of laws and customs of a nation's creation the moment that nation engages in the affairs of any nature within foreign territory. Any hostile act or proxy war, entertained on foreign soil, renders aggressors and their counterparts not adhering to international law, liable, via legal proximity, towards the targeted nation whose legal authorities or customs subscribe to international law. Of course, any lethal act which causes or has the effect to indiscriminately cause unarmed human casualty also becomes a crime against humanity. And crimes against humanity need not be identified nor sanctioned via a national authority in order to be recognized as such - the mere fact of violating human dignity and worth shocks the conscience of humanity and requires rigorous dissuasive intervention prescribed through international legal framework in order for punitive measures to have an effect globally.  ...

25. Public policies founded on Tacit Consent (TC) fail to safeguard and valorize human dignity and worth. Organ donation/transplant policies become lethal the moment policy-makers and their lobbying counterparts transgress the sanctity of bodily property. State-enforced TC maliciously takes advantage of the ignorance and/or inadvertence of the assumed defaulting mute party. Worse than hearsay evidence (unlawful under valid rule of law), TC perpetuates a nefarious custom involving all players of the Healthcare industry. Monstrous ploys of the type denounced via U.S. H.Res.343 expose the capacity of first responders and/or hospital staff to initiate or participate in fraudulent practices feeding the organ transplant industry. 26. It doesn't take rocket science to ascertain that belief coercion continues to attract conflicts devised to serve nefarious goals. Therefore, much like a rainbow -- the product of a genuine natural phenomenon lasting as long as its distinct colors never blur the lines -- multiculturalism safely thrives where pluralistic societies (rainbows) reflect distinct groups (rainbow colors) subscribing to collective secular ideals (rainbow arc). Everything in the above assertion seems acceptable at the international level, but the following sovereign analysis adheres to immutable fundamental principles:

    • Ensuring cultural and religious homogeneity within a heterogeneous society requires stringent control of immigration policies. Conservative policies based on founding cultural and religious proximity defend sovereign legitimacy. In that sense, Diversity works best within a collective founded on a unique cultural and religious background. Beyond sovereign borders, multiculturalism becomes a melting pot of competing interests unfit to defend and promote Sovereignty.  ...

27. No act or omission escapes the scrutiny of valid Justice. It is strictly the verifiable effects of illegal human behavior that justifies reciprocal compensatory and punitive measures sanctioned by Law. Only science must serve to determine prohibited physical acts/omissions (Actus Reus) and the guilty mind (Mens Rea) disclosing tangible motive(s). Besides limiting Rights and Freedoms, the Domino analysis also serves as a judicial process validating scientific findings sequentially tied to ulterior motives. There must contain no motivational gaps between findings within a Domino sequence. Through Reciprocity rule, the guilty are either subject to fines and/or incarceration (infinite/temporary) or capital punishment - with punitive measures reflecting the severity of violated Rights and Freedoms suffered upon victims. Because of their intangibility in both criminal and civil cases, mental impairment and hearsay evidence cannot be relied upon. 28. The compromising political culture is one which, among other things, dupes and financially hijacks citizens to the benefit of public/private entities abusing the public treasury. Corrupt elected officials avoid any form of constitutional scrutiny from their constituents. The unconstitutional acts of idiocratic governments are the reflection of the community dependent on austere policies aimed, inter alia, at enriching the elite links of the commercial chain that intransigent politics takes care to develop and protect. The eradication of such viral system requires the adoption of an insoluble democratic formula that ensures primacy, responsibility, and the obligation of the citizen towards the community. Through Deliberative Democracy, the citizen authorizes responsible authorities to administer public affairs according to a constitutional legislative framework. Permanent constitutional committees, governed by technocrats selected on merit, regulate equitably, according to the available budget, all that belongs to the public domain subsequent citizens' deliberation of national bills and regulations. Ultimately, compromising deputation and enabling political parties lose all legitimacy, thus ensuring a democratic shift towards a proactive citizen formula.  ...

Good governance requires all government agents to do the right thing, which obviously does not relieve any official authority of its democratic duties ensuring unwavering submission to valid Rule of law. Thus, Rule of Law that does not provide safeguards and punitive measures against violation of the People's Will is a rule of law devoid of any constitutional validity. A supposedly free and democratic society, based on Rule of Law allowing any of the following non-exhaustive systemic failures, invites a government of charlatans:

Legislative

• Law/custom granting immunity;

• Law explicitly devoid of any sanctions subsequent its violation;

• Law which core principles/objectives allow interpretative analysis;

• Law which effects unjustly discriminate and/or violate innate/acquired rights;

• Law impervious to valid international law, to the adopted constitutional order;

• Etc ... .

Executive

• Public commissions/inquiries tainted by conflicts of interest;

• Overlapping jurisdictions and taxation duplication;

• Bloat of government bureaucracy unaffected by austerity measures;

• Ministerial performance credits based on ministerial quotas;

• Private enterprise affecting the administration of government;

• Etc ... .

Judicial

• Judicial nominations not based on merit and/or affected by political incursion;

• Judicial decisions founded upon or comprised of beliefs and/or subjective analyses;

• Judicial appeals rejected on unconstitutional grounds;

• Bureaucracy unjustly denying access to justice;

• Invalid judge-made law, judicial bias;

• Etc ... .

The solution is simple: Separation of powers, when left unchecked, invites arbitrary rule. That doctrine must therefore be regulated via a constitutional authority ensuring proactive supervisory control of the creation and execution of anything law. A constitutional body ...

30. Ecoworth, Democracy, Economy - The only sustainable foundations needed to secure -- under that specific order -- progressive societies governed via universal Rule of Law:

1. 1. ECOWORTH: Human activity never going against the natural equilibrium of natural resources and climate. Abusive anthropogenic interference, inter alia, destabilizes local climates provoking accelerated and artificially-induced global climate change. All human activity must solely be contained for the return of a global natural equilibrium. Any human activity whose outcome provokes a breach of natural equilibrium becomes an ecocide that must be repaired and avoided.

   2. DEMOCRACY: To ensure fulfillment of autonomous societies in tune with ecoworthy ideals, the Declaration of Democratic Rights and Freedoms (DDRF) contains all the necessary means helpful in securing citizen empowerment. Preferred vertical hierarchy for governing bodies should reflect unique jurisdictions and competencies:

      • Federation - A constitutional body acting as federal regulator of member States, enabling normalization of interstate law and regulatory regimes, its administrative role comprising exclusive jurisdiction securing the autonomy of regions.

      • State - An autonomous region, member of the federation, comprising a Legislative Assembly enacting regulatory regimes affecting all its divisions, in accordance to federal constitutional law.

      • Division - A sector acting under the laws of the enabling State, comprising a legislative Assembly enacting regulatory regimes conforming to State Law.

   3. ECONOMY: The only economy worth undertaking is the kind under universal Rule of Law which restores and secures the equilibrium of natural resources while safeguarding and valorizing human dignity and worth. Current global economies disrupt through use of climate-altering non-renewable resources. Progressive economics seek to contain human consumption at levels Nature can ecologically resorb, anything else being suicidal for all living species.  ...

31. In valid Democracies, Oaths of Office exercised by public agents bind them to the Will of the People under the constitutional prerogatives of Rule of Law. This doctrine seeks compliance of governing officials towards fulfilling their obligation of legitimately serving the public responsibly, through enabling law. Because of their constitutional ambit, any official act or omission that contravenes these Oaths of Office must be sanctioned according to Criminal Law. A violation must automatically include the immediate suspension of all powers defendant holds during office - those powers may be transferred to other officials while the discovery process is under way. Once evidence has been demonstrated, disqualification of any future attempt(s) at entertaining any public position within any public body is obligatory. Oaths of Office are constitutional guarantees sworn by those governing. For public officials, breaking those guarantees indeed requires harsh punitive measures serving, inter alia, to enforce rule of law, restore public confidence, and deter future violations.  ...

32. Despots in position of authority avoid democratic scrutiny like the plague. The reason is quite simple: True democratic institutions afford constitutional scrutiny aiming for legitimate balance of powers, while institutions under tyrannical rule do not. Despots that claim "democratic" underpinnings in support of their oppressive politico-judicial regime are con artists of the lethal kind, with electoral fraud, bribery, and corruption the major drivers behind their winnings. Warmongers and allies provoke other sovereign Nations in an attempt to justify invasion and subsequent control. Domestically, corrupt rule aims to oppress and constrain society in a manner profitable for organized crime. Military intervention -- internal or foreign -- is basically what drives the economic progress of warmongers since it is only through fear, provocation, and violence that they can maintain their lethal authority. 33. Official and unofficial acts and omissions threatening the established constitutional order can serve to constrain or eliminate public institutions that do not facilitate the offending viral need to ensure the foundation for oppressive politico-judicial change. Any civil, public, and judicial authority, impacting in an adverse manner constitutional scrutiny, invites tyranny.
